RENTAL TERMS & CONDITIONS

Welcome to Apex Exotics! By accessing our website and booking a vehicle with Apex Exotics, you agree to abide by the following Terms and Conditions. Please read these terms carefully, as they contain important information about your rights and obligations.

 

1. Eligibility and Age Requirements

 

• Minimum Age: To rent a vehicle from Apex Exotics Inc., you must be at least 25 years old.

• Driver’s License: You must hold a valid, full driver’s license issued in Canada or an equivalent license recognized in Ontario.

• Insurance: Renters are required to carry personal auto insurance that covers exotic car rentals, or they may purchase insurance coverage through Apex Exotics.

 

2. Reservations and Payment

 

• Booking Confirmation: Reservations are only confirmed once payment has been processed, and you have received a booking confirmation email.

• Payment Terms: Full payment is required at the time of booking. We accept major credit cards. A refundable security deposit may also be required.

• Security Deposit: A security deposit may be held on your credit card for the duration of the rental. The deposit will be refunded after the vehicle is returned, provided no additional charges apply.

 

3. Cancellation Policy

 

• Cancellations: If you need to cancel a reservation, please contact us as soon as possible.

• Refund Policy: Cancellations made more than 48 hours before the rental date will be refunded in full. Cancellations made within less than 48 hours of the rental date may incur a fee or be non-refundable.

• Modifications: We will try to accommodate changes to your reservation, but changes are subject to vehicle availability and may incur additional fees.

 

4. Rental Period and Late Returns

 

• Rental Duration: The rental period is stated in your booking confirmation. Vehicles must be returned on or before the agreed-upon date and time.

• Late Returns: Late returns will incur additional charges based on the hourly or daily rental rate. Please contact us if you expect to be late.

 

5. Vehicle Use and Restrictions

 

• Authorized Drivers: Only individuals listed in the rental agreement are authorized to operate the vehicle.

• Prohibited Uses: The vehicle may not be used for any illegal purposes, racing, towing, off-road driving, or any activities that could endanger the vehicle.

• Mileage Limits: Each rental includes a set mileage limit. Exceeding this limit may result in additional charges.

• Care of Vehicle: Renters must take reasonable care of the vehicle and are responsible for keeping it in good condition throughout the rental period.

 

6. Liability and Insurance

 

• Damage Responsibility: Renters are responsible for any damage to the vehicle during the rental period, including theft, collision, and vandalism.

• Insurance Requirements: Renters must have adequate insurance coverage or purchase optional insurance through Apex Exotics Inc. to cover potential liabilities.

• Accident Reporting: In the event of an accident, renters must immediately notify Apex Exotics Inc. and, if applicable, the local authorities.

 

7. Fees and Charges

 

• Additional Charges: Renters may incur additional charges for excess mileage, tolls, parking tickets, traffic violations, or returning the vehicle with less fuel than provided.

• Cleaning Fee: A cleaning fee may be applied if the vehicle is returned excessively dirty or requires extra cleaning.

• Damage Fees: Charges for damages will be deducted from the security deposit or charged to the renter’s credit card if they exceed the deposit.

 

8. Indemnification

 

By renting a vehicle, you agree to indemnify and hold harmless Apex Exotics Inc., its employees, and affiliates from any claims, damages, liabilities, and expenses arising out of your use of the vehicle, including but not limited to any violations of these terms.

 

9. Limitation of Liability

 

Apex Exotics Inc. is not liable for any indirect, incidental, or consequential damages arising from your use of our vehicles. Our liability for any claims related to your rental is limited to the total amount paid by you for the rental period.

 

10. Privacy Policy

 

Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.

 

11. Termination of Agreement

 

Apex Exotics Inc. reserves the right to terminate your rental agreement if you violate any of these terms and conditions. In such cases, the vehicle must be returned immediately, and no refund will be issued.

 

12. Governing Law

 

These terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Ontario.

 

13. Amendments

 

Apex Exotics Inc. reserves the right to amend or update these Terms and Conditions at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the updated terms.
